<div><b>Text:</b> <p>Supreme Court of Ohio Chief Justice Thomas J. Moyer, Gov. Ted Strickland and House Speaker Armond Budish will be among the Ohio leaders at a forum to discuss the process for selecting Justices of the Supreme Court of Ohio on Nov. 19 and 20 at the Ohio Judicial Center and the Center of Science and Industry (COSI) in Columbus.</p>
<p>The conveners of the event, “A Forum on Judicial Selection: A Time for Action,” are Chief Justice Moyer, the Ohio State Bar Association and the League of Women Voters of Ohio Education Fund. The forum is made possible by a grant from the Joyce Foundation.</p>
<p>Also scheduled to be in attendance will be Justices Paul E. Pfeifer, Evelyn Lundberg Stratton and Robert R. Cupp.</p>
<p>The purpose of the forum is to address the widespread public perception that campaign contributions influence judicial decision-making. Participants will explore whether Ohio should adopt a new selection method for Supreme Court Justices and will learn about the various reforms that other states have implemented.</p>
<p>Participants include leaders of the judicial branch, the business community, organized labor, state elected officials, civic leaders and members of the legal community.</p>

<div><b>Text:</b> <p>Between 1939 and 1945, approximately 16 million U.S. soldiers served in what is still the deadliest military conflict in history, World War II. While many gave the ultimate sacrifice to their country, the surviving veterans returned home as heroes nearly 65 years ago—and with each passing day, fewer and fewer remain to witness the legacy of freedom and prosperity they secured for our nation.</p>
<p>That is why Honor Flight Columbus, a regional hub of the national nonprofit organization Honor Flight Network, is dedicated to providing free trips for WWII veterans to Washington, D.C., to see the World War II Memorial, the Iwo Jima Memorial and Arlington National Cemetery. These one-day trips allow veterans to not only see the memorials honoring their military service, but also to reflect on their sacrifices to our country and their place in world history.</p>
<p>The organization’s final flight of 2009 occurred on Nov. 7, with 80 veterans and more than 50 guardians on board (guardians pay their own way), and returned later that day to an emotional welcome home by upwards of 400 family members, friends and supporters at Port Columbus Airport. The trip capped off a year in which Honor Flight Columbus ushered more than 500 WWII veterans to Washington, D.C. on 12 separate flights, a number that pushes the Honor Flight Network closer to its goal of providing free trips to 25,000 veterans in 2009.</p>

<div><b>Text:</b> <p>The Supreme Court of Ohio recently released a publication that provides practical information about the lawyer-client relationship for Ohioans considering hiring an attorney.</p>
<p>A joint project of the Supreme Court’s Clients’ Security Fund and Commission on Professionalism, the guide is intended to promote the public’s confidence in the integrity of the legal profession in Ohio.</p>
<p>It is hoped that Ohioans use this guide with its easy-to-understand terms for help in finding a lawyer, what to expect after hiring a lawyer, how to avoid problems in the lawyer-client relationship, and what steps to take if problems do occur. The guide also contains a glossary of common legal terms and their definitions.</p>
<p>“Hiring an attorney can present many challenges to someone unfamiliar with the legal system,” said Janet Green Marbley, administrator of the Clients’ Security Fund. “The tips included in this consumer guide should go a long way toward establishing a comfort level when the need arises to hire an attorney.”</p>
<p>Lori Keating, secretary to the Commission on Professionalism, said other aspects of the guide speak to the duties that the attorney and the client have when working together. “Appreciating the roles each person plays and how one’s actions affect the other should reduce misunderstandings and lead to more successful attorney-client relationships.”</p>
<p>The guide will be distributed through multiple channels to reach Ohio consumers, including judges, clerks of court, legal aid offices and public defender offices. Attorneys should contact the Clients’ Security Fund or Commission on Professionalism for free copies to distribute to their clients.</p>

<div><b>Text:</b> <p><span>As new lawyers admitted to the Ohio bar last week begin in earnest this week to chart their professional careers, a nationally recognized Supreme Court of Ohio mentoring program can go a long way toward helping them start off on the right foot.</span></p>
<p><span></span><span>The Lawyer to Lawyer Mentoring Program is a one-year voluntary program that pairs new lawyers with experienced attorneys to help ease the transition from law school to law practice. The program was initiated by Chief Justice Thomas J. Moyer and Justice Terrence O’Donnell and developed by the Supreme Court Commission on Professionalism, with input from law schools, bar associations and law firms throughout Ohio. A pilot program was offered to new lawyers admitted in 2006. The permanent program began last year.</span></p>
<p><span></span><span>In letters sent out today to new lawyers, Justice O’Donnell encouraged them to participate in the program. “A mentor provides practical advice and assists in your development of lawyering skills,” Justice O’Donnell wrote. “In addition, a mentor listens to your concerns, offers encouragement, and expands your networking. A mentor can answer the questions that will inevitably arise at the start of and during your legal career.”</span></p>
<p><span></span><span>In addition to the benefits intrinsic in mentoring, mentors and new lawyers can earn continuing education credit for free. Attorneys who act as mentors will earn 12 hours of CLE credit at the completion of the program, including one hour of professionalism, one hour of ethics and one-half hour of substance abuse. Upon completing the program successfully, new attorneys will have earned nine of their required 12 hours of New Lawyers Training.</span></p>
<p><span></span><span>Justice O’Donnell called the arrangement a win-win scenario for everyone, especially for attorneys experiencing hardships during these challenging economic times.</span></p>
<p><span></span><span>Attorneys who participate in the program will complete a mentoring plan that will include nine hours of mentoring during the course of six in-person meetings. Discussion topics range from law office management and client communication to substance abuse and mental health. Supplemental materials from the commission are provided online to guide the discussion and ensure consistency in program content.</span></p>
<p><span></span><span>New lawyers must register for the program by Jan. 8, 2010. To be eligible to participate, new lawyers also must have registered for active status with the Court (due within 30 days of admission) and practice or intend to practice law in Ohio.</span></p>
<p><span></span><span>Justice O’Donnell stressed that experienced lawyers understand the value and need for mentoring more than new lawyers. New lawyers often express regret a year or two in to their professional lives about not taking advantage of the program.</span></p>
<p><span></span><span>There are three ways to get involved:</span></p>
<ul>
<li><span>New lawyers can access the </span><a title="Click here to access the list" href="http://www.supremecourt.ohio.gov/AttySvcs/mentoring/MentorList.aspx"><span><span class=ms-rteCustom-LinkText>list</span></span></a><span> of pre-approved mentors and select their top three choices;</span></li>
<li><span>New lawyers or mentors can complete an </span><a title="Click here for an application" href="http://www.supremecourt.ohio.gov/AttySvcs/mentoring/applications.asp"><span><span class=ms-rteCustom-LinkText>application</span></span></a><span> online if a match has already been made; and</span></li>
<li><span>Employers can match new lawyers with mentors within their firm. <div><b>Text:</b> <p><span>The Ohio State Bar Association Labor and Employment Law Section Award is presented annually to recognize outstanding scholarship and promote law student interest in the areas of labor, employment and/or employment discrimination law.</span></p>
<p><span></span><span>The student selected for the award will receive a copy of <span>“Labor and Employment Law Compliance and Litigation,” published by Thomson-West,</span> and a cash award of $500. In the event that the judgment of the law school considers that there is more than one exceptionally worthy student, the school may select a second student to receive an identical award.</span></p>
<p><span></span><span>A recipient is chosen by his or her law school. The following criteria are applicable to the law school in making its determination:</span></p>
<ul>
<li><span></span><span>Academic achievement in labor, employment and/or employment discrimination law topics;</span></li>
<li><span></span><span>A demonstrated interest in the foregoing areas (e.g., an internship, law review/journal paper topic or similar, as approved by the particular law school); and</span></li>
<li><span></span><span>A recommendation by a member of the school’s faculty or a labor/employment law attorney.</span></li></ul>

<div><b>Text:</b> <p>On June 3, 2007, an Ohio State Highway Patrol Trooper stopped a suspect for driving under the influence of alcohol. A camera in the trooper’s cruiser recorded the encounter.</p>
<p>Subsequently, the defendant filed a motion and requested that the videotape from the trooper’s cruiser be preserved. The trial court approved the motion. The parties did not know, however, that lightning had struck the patrol post the day of the defendant's arrest and destroyed videotape evidence, including the recording of the defendant's stop.</p>
<p>When the defendant learned that the videotape had been destroyed, he moved to dismiss the case. The parties submitted the matter to the trial court on briefs and testimony taken from another case that involved the same issue.</p>
<p>Did the State fail to preserve materially exculpatory evidence? Should the defendant have the case dismissed?</p>

<div><b>Text:</b> <p><span><span class=ms-rteCustom-articleBody>The Ohio State Bar Association Environmental Law Committee is seeking papers that advance the application and practice of environmental, energy or resources law in the State of Ohio. The winner of this contest will receive the OSBA Environmental Law Award and a prize of $1,000, donated by McMahon DeGulis LLP.</span></span></p>
<p><span><span class=ms-rteCustom-articleBody></span></span><span><span class=ms-rteCustom-articleBody>Winners will be announced at the Annual OSBA Environment, Energy and Resources Law Seminar in April 2010 and will be published in the seminar materials.</span></span></p>
<h4><span><span class=ms-rteCustom-articleBody><strong>The submission deadline is January 31, 2010 at 5 p.m. EST.</strong></span></span></h4>

<h2><span><span class=ms-rteCustom-articleBody></span></span><span class=ms-rteCustom-articleBody><strong>Topic: </strong>Any<strong> </strong>topic that advances the application and practice of environmental, energy or resources law in the State of Ohio.</span></h2>
<p><span class=ms-rteCustom-articleBody><strong>Eligibility: </strong>You are eligible to enter the OSBA Environmental Law Call for Papers if you are currently enrolled in law school. The submission must be the student's original, unpublished and uncopyrighted work. The paper may be prepared to satisfy a course requirement or for other academic credit. However, the paper must be the work of the submitting student without substantial editorial input from others. Only one paper may be submitted per entrant.</span></p>
<p><span class=ms-rteCustom-articleBody><strong>Prize:</strong> The winner of this contest will receive a prize of $1,000. The OSBA Environmental Law call for papers requires that there be only one winner. Joint submissions are not permitted.</span></p>
<p><span class=ms-rteCustom-articleBody><strong>Submissions:</strong> Submissions may be of any length up to a maximum of 50 pages, in a double spaced, 8.5x11-inch page format with 12 point font (10 point for footnotes). All entries must be submitted electronically to </span><a title="" href="mailto:envlaw@mdllp.net"><span><span class=ms-rteCustom-articleBody><span class=ms-rteCustom-LinkText>envlaw@mdllp.net</span></span></span></a><span class=ms-rteCustom-articleBody>. You will receive a confirmation by email. The subject line should be &quot;Response to Call for Papers&quot; and the paper and cover page should be separate attachments. </span></p>
<p><span class=ms-rteCustom-articleBody>Each submission should include a <strong>separate cover page </strong>with the entrant's name, law school, year of study, mailing and e-mail addresses, and phone number. The contestant's name and other identifying markings, such as school name, may not appear on any copy of the submitted essay. The cover page should also include an abstract of not more than 250 words and certification that the article has not been published or is not slated to be published elsewhere.  </span></p>
<p><span class=ms-rteCustom-articleBody>Submissions must be received by 5 p.m. EST on January 31, 2010.</span></p>
<p><span class=ms-rteCustom-articleBody>A random number will be assigned to each entry and record of this number on all copies of each essay submitted. Neither the contestant's identity nor his or her academic institution will be known to the selection committee.</span></p><span class=ms-rteCustom-articleBody><strong><span>Selection:</span></strong><span> Submitted articles will be judged on the following criteria: relevance to the practice of law in Ohio, timeliness and importance of selected topic; organization; quality of legal analysis; quality of legal research; and quality of the overall writing. The winning paper is expected to be of law review quality or better.</span></span></div>
