Board of Governors proposes OSBA constitutional amendment


TO THE MEMBERS OF THE OHIO STATE BAR ASSOCIATION

Effective January 1, 2012, The Supreme Court of Ohio adopted amendments to Rule V of the Rules for the Government of the Bar which, among other actions, limited the terms of members of certified grievance committees. To assist with continuity and to assure continued involvement by experienced lawyers, the Board of Governors has proposed adoption of the amendments to the OSBA Constitution as set forth below.

The proposed amendments will continue the Legal Ethics and Professional Conduct Committee as the OSBA's certified grievance committee and will assign to the newly-created Professionalism Committee the other functions related to the practice of law and administration of justice.

The proposed amendments will be considered at the meeting of the General Assembly to be held at 3:00 p.m. on Wednesday, May 8, 2013, at the Renaissance Cleveland Hotel, Cleveland, Ohio.

In accordance with Article XX of the Constitution of the Ohio State Bar Association, a majority of the members of the Board of Governors propose adoption of the following amendment to the Constitution.  Where the recommendation is to delete language, that language is struck through. Where the recommendation is to add language, that language is underlined.

Article XVI: Committee on Professionalism Committee and Legal Ethics and Professional Conduct Committee

 §16.1  The Professionalism Committee on Legal Ethics and Professional Conduct shall receive, consider and act upon all matters affecting legal ethics and professional conduct of the legal profession relating to the practice of law and the administration of justice and report the same with such recommendations as the Committee may deem advisable and may prepare and publish opinions dealing with the subject.
§16.2  The Committee on Legal Ethics and Professional Conduct shall process all allegations of misconduct coming to its attention and take appropriate action thereon.
